What is a Planning Permit?

A Greater Dandenong  City Council planning permit is a legal document giving permission for land use or development.
This development or use could be anything from demolishing or house extensions or removing a tree in your garden to running a business from home or getting a liquor license for a bar
Planning is essential when making decisions that affect the environment and everyday life.
Planning decisions take into account the impact a new building or land use will have on the Melbourne neighbourhood and neighbours. These decisions might be about the location of a new restaurant, the size of a new shopping centre or the parking allocation for a new apartment building.

It is an offence to use or to develop the land if that use or development needs a planning permit and you have not obtained one.

When is planning permit required?

Some of the most common reasons a planning permit is needed by Greater Dandenong  City Council are:

  • Starting a business
  • Constructing, altering, or extending a building
  • Subdivision of land
  • Clearing native vegetation from land
  • Displaying a sign
  • Changing the use of a property
  • Applying for a liquor licence

A planning permit only applies to the land for which it has been granted. Permits are usually subject to conditions, including the approval of plans by Greater Dandenong  City Council.

What is a Building Permit?

A small number of building works are exempt from a building permit (see below). For a full list of exemptions, see Schedule 3 of the Building Regulations 2018. The best way to find out if you need a building permit in the Greater Dandenong  City Council area is to contact the council, which is a free service.

IMPORTANT: If your project requires a planning permit, then you must have the planning permit BEFORE you can apply for a building permit.

Which projects require a building permit?

Why do I need a building permit?

A building permit assures the Greater Dandenong  City Council that your building project:

  • is built by a registered builder
  • has the correct documentation
  • is inspected at different stages of work, and
  • is independently assessed as finished and/or suitable for occupation.

A building permit also lists the types of inspections your project must have at different stages of work.

For example:

Your building project may need to be inspected for footing, steel reinforcement, frame and require a final inspection.

There may also be other permits and approvals.

IMPORTANT: Large fines apply if you build without the correct permits and you may be forced to demolish illegal buildings.

Projects that require a building permit

You may need a building permit for large projects like:

A new home or factory, swimming pool, extensions, renovations, demolition, and building removal.

You may also need a building permit for smaller projects like:

New fencing, re-stumping, retaining wall, boundary wall, spa, safety barrier for a swimming pool or spa, garage, carport, outbuilding, verandah, and pergola.

There are many exemptions for building work and buildings. These are detailed in Schedule 3 of the Building Regulations 2018 which describes situations where a building permit is not required:

    • is not an essential safety measure, or
    • does not increase or decrease the floor area or height of the building, or
    • is not being carried out on, or in connection with, a building included on the Heritage register established under the Heritage Act 1995, or
    • is not removal or alteration of any element of the building that is contributing to the support of any other element of the building, or

    • A relocatable swimming pool that is erected temporarily in an area that is enclosed by barriers complying with AS 1926.1 – 1993 Swimming Pool Safety Part 1: Fencing for swimming pools. Note, the safety barriers around the pool need a permit.

    • not exceeding 2 metres in height, or

A retaining wall less than 1 metre in height that is not associated with other building work or with protection of adjoining properties.

    Pergola to a domestic residence
